EU Regulations in
ATM
The EU has passed new regulations governing Air
Traffic Management in European Airspace. These regulations cover issues such
as: the Single
European Sky, Interoperability of ATM systems, Airspace Management and the
provision and regulation of Air Navigation Services.
These regulations are likely to have a dramatic impact
on European ATM, as they apply directly to the 25 member States of the EU and
indirectly to prospective members. Many other States are likely to follow the
lead of the EU - as ICAO encourages the safety and performance of Air
Navigation Services to be subject to independent scrutiny and safety
assessment.
Single European Sky:
Framework Regulation Regulation
(EC) No. 549/2004 of 10th March, 2004.
This regulation lays down the framework for the
creation of the Single European Sky. The objective and scope of this regulation
is to enable EU powers to improve safety and efficiency, reorganise airspace,
enhance capacity and to take action to reduce delays across European
airspace.
Organisation and Use
of Airspace: The Airspace Regulation Regulation
(EC) No. 551/2004 of 10th March, 2004.
This regulation sets out the means for the
organisation of airspace in the Single European Sky. The objective and scope of
this regulation is to support the progressive integration of European airspace
and to establish common procedures and arrangements for the design and
management of airspace in support of the safe performance of the Single
European Sky.
Interoperability of
the European ATM Network: Interoperability Regulation Regulation
(EC) No. 552/2004 of 10th March, 2004.
This regulation sets out to implement the
harmonisation and interoperability of air traffic management systems towards
the further integration of the European Air Traffic Management Network, in line
with the objectives of the Single European Sky.
The Provision of Air
Navigation Services: Service Provision Regulation Regulation
(EC) No. 550/2004 of 10th March, 2004.
This regulation specifies common regulations for all
Air Navigation Service Providers and the responsibilities of, and requirements
for, the National supervisory bodies. Many Air Navigation Service providers
will have to formalise their safety management responsibilities and activities.
The National Supervisory Bodies will have to explicitly check that appropriate
levels of safety are being achieved and that the operations of the Air
Navigation Service Providers are demonstrably safe.The regulation also gives
the EU powers to audit the National supervisory bodies.
Common Requirements
for the Provision of Air Navigation Services Regulation (EC)
No. 5XX/2004.
This, as yet unpublished, regulation is currently out
for consultation with member States. Specifically, this regulation will bring
into force, previously voluntary rules drafted by Eurocontrol, namely:
- ESARR 3 on Safety Management Systems (SMS) for Air
Navigation Services
- ESARR 4 on Risk Assessment and Mitigation for
ATM
- ESARR 5 on Safety Regulatory Requirement for ATM

Eurocontrol will be responsible for managing the
industry consultation process with stakeholders. Curiously, Eurocontrol still
insist on calling the implementing rules "Eurocontrol Rules", despite the fact
that they will actually be EU Regulations (as Eurocontrol has no power to
